As you may know, we (LVHOA) sued the city in 2013, to get them moving on our sinkhole repairs. Norm Ryan, Esq with the firm Ryan Mercaldo & Worthington LLP is our attorney. We have been following this issue since 2010. There is obviously a long history and we have an archive of emails going back to 2013.
In addition to coordinating with our attorney, We have been attempting to get information and commitments from City employees. So far we have nothing in writing nor do we have a specific schedule for completing the repairs. The last word we received from the Project Manager, Will Meredith, is that due to further erosion, they are redesigning the planned repairs. There are also issues with the City getting necessary permits and finding mitigating land for the land at the bottom of the sinkhole they will cover with the new design. The last time we contacted Meredith, he indicated the sinkhole would likely be repaired by summer of 2017. We asked for a specific schedule but he could not commit. Of course, we also heard in 2013 that it would be repaired before winter 2014.
After Norm Ryan filed the lawsuit, we agreed to stay the suit as the City indicated they would be moving ahead with repairs. Obviously, no construction has begun and, as far as we know, no contracts have been let. As advised, the stay has been lifted.
On October 14, Norm Ryan attended a Case Management Conference before Judge Gregory Pollack.
